Progress on Transposition EU Directive on Whistleblowing Directive Suspended
Legislative progress on the transposition of the EU Directive is suspended in Italy.
The next step was for Parliament to approve a law to mandate Government to begin implementation. Article 23 of this Bill of Law or “Legge Delegazione” covers transposition of the whistleblowing protection Directive was expected to be approved in March and would mandate the Ministry of Justice and the Department of European Policies to draft new legislation.
The Bill has however been amended in the House of Representatives and therefore is returned back to the Senate as of 01 April 2021.
No date for the voting at the Senate has yet been scheduled.

Parliamentary assembly discusses preparatory work to transpose EU Directive on Whistleblowing
After much delay, discussions on the preparatory work for a draft law to implement the EU Directive on Whistleblowing into Italian law are now underway in the parliamentary assembly. Responsibility to for transposition of the Directive, which must take place before the 17 December 2021 is understood to be shared between both the Ministry of Justice and the Department for European Policies within the Prime Minister’s office. Proposed amendments to the draft legislation made by the Parliamentary Commission can be read here. Once approved, the law will officially appoint these Ministries and implementation of the Directive can commence.

The Senate of the Republic, the upper house of the Italian Parliament, has passed a draft law to mandate the Government to begin transposition of several European Union laws into national law (33 in total) including the EU Directive on Whistleblowing. Such a Bill officially appoints the Government or relevant Ministries to deal with transposition and required approval by both Chambers.
